Use of Services Policy

This Use of Services Policy (“Policy”) governs all services provided by PPwix Website Services (“Company,” “we,” “our,” or “us”). By engaging our services, the client (“Client,” “you,” or “your”) agrees to be bound by this Policy.

1.General Terms of Service

1.1 Lawful Use Only
Client agrees to use all services in compliance with all applicable local, state, federal, and international laws and regulations.

1.2 Prohibited Activities
Client may not use Company services to:

  • Distribute malware, viruses, or malicious code
  • Conduct phishing, fraud, or deceptive marketing practices
  • Host illegal, defamatory, obscene, or infringing content
  • Violate intellectual property rights
  • Send unsolicited bulk email (spam)
  • Engage in abusive, harassing, or harmful behavior

1.3 Right to Suspend or Terminate
Company reserves the right to suspend or terminate services immediately, without notice, for violations of this Policy.

1.4 No Ownership Transfer
All custom work remains the intellectual property of the Company until paid in full.

2. Website Design & Development Services

2.1 Scope of Work
All services are limited to the scope defined in the written proposal, invoice, or contract.

2.2 Client Responsibilities
Client agrees to:

  • Provide timely content, assets, and approvals
  • Ensure all provided materials are owned or licensed
  • Review and approve deliverables within reasonable timeframes

2.3 Revisions
Revisions beyond the agreed scope will be billed at the Company’s standard hourly rate.

2.4 Third-Party Components
Websites may utilize third-party software, plugins, APIs, or platforms. Company is not responsible for:

  • Changes made by third-party providers
  • Discontinued features
  • Licensing changes
  • Compatibility issues caused by third-party updates

2.5 Post-Launch Modifications
Any modifications after project completion are considered new work and are billable.

2.6 No Performance Guarantees
Company does not guarantee specific conversion rates, traffic volumes, sales outcomes, or business results.

3. Hosting Services Policy

3.1 Acceptable Use
Hosting services are provided solely for legitimate business or personal website use.

3.2 Prohibited Hosting Content
Client may not host:

  • Illegal content
  • Pirated software or media
  • Adult content (unless explicitly approved)
  • Cryptocurrency mining software
  • Automated bulk mailing systems
  • High-resource applications without prior approval

3.3 Resource Usage Limits
Company may impose CPU, memory, storage, bandwidth, and email limits. Excessive resource usage may result in:

  • Temporary throttling
  • Additional fees
  • Account suspension

3.4 Email Policy

  • Bulk email campaigns are prohibited unless pre-approved.
  • Company reserves the right to suspend email services if domain/IP reputation is at risk.
  • Client is responsible for maintaining proper SPF, DKIM, and DMARC where applicable unless PPwix Website Services is managing DNS records.

3.5 Backups
While Company may perform routine backups, Client remains solely responsible for maintaining independent backups of all website data.

3.6 No Uptime Guarantee Unless Contracted
Unless explicitly stated in a written SLA, uptime is provided on a best-effort basis without guaranteed availability percentage.

3.7 Security
Company provides standard server-level security measures; however:

  • No hosting environment is immune to cyber threats.
  • Client is responsible for strong passwords and account security.
  • Company is not liable for breaches caused by Client negligence.

4. Technical SEO Services Policy

4.1 Scope of Technical SEO
Technical SEO services may include:

  • Site audits
  • Core Web Vitals optimization
  • Structured data implementation
  • Sitemap and robots.txt configuration
  • Indexation improvements
  • Schema markup
  • Internal linking optimization
  • Crawl error resolution

4.2 No Ranking Guarantees
Company makes NO guarantees regarding:

  • Search engine rankings
  • Specific keyword placement
  • Traffic increases
  • Revenue increases
  • Indexation timelines

Search engines such as Google operate on proprietary and constantly evolving algorithms outside the Company’s control. Rankings may fluctuate due to:

  • Algorithm updates
  • Competitor activity
  • Market changes
  • Industry shifts
  • External backlinks
  • Search engine policy changes

4.3 No Control Over Search Engines
Company does not control and cannot influence:

  • Google, Bing, or other search engine algorithms
  • Manual actions or penalties issued by search engines
  • Third-party backlink profiles

4.4 Client Acknowledgement
Client acknowledges:

  • SEO is a long-term strategy
  • Results are not immediate
  • Technical improvements do not guarantee ranking improvements
  • Search engines may choose not to index content

4.5 No Liability for Ranking Loss
Company shall not be held liable for:

  • Ranking drops
  • Traffic decreases
  • De-indexation
  • Penalties
  • Business losses related to organic search performance

4.6 No Black Hat Practices
Company will not engage in:

  • Link schemes
  • Keyword stuffing
  • Cloaking
  • Hidden text
  • Private blog networks
  • Any practice that violates search engine guidelines

5. Payments & Billing

5.1 Non-Refundable Deposits
All deposits are non-refundable unless otherwise stated in writing.

5.2 Late Payments
Late payments may result in:

  • Suspension of services
  • Website deactivation
  • Late fees
  • Collection actions

5.3 Chargebacks
Initiating a chargeback without first attempting resolution constitutes breach of agreement and may result in immediate termination of services.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Company shall not be liable for indirect, incidental, special, or consequential damages.
  • Company’s total liability shall not exceed the total fees paid by Client for the service in question during the preceding 3 months.
  • Company is not liable for lost profits, data loss, business interruption, or reputational harm.

7. Indemnification

Client agrees to indemnify and hold harmless the Company from any claims, damages, liabilities, or expenses arising from:

  • Client content
  • Client business practices
  • Misuse of services
  • Violation of laws

8. Modifications to Policy

Company reserves the right to modify this Policy at any time. Continued use of services constitutes acceptance of revised terms.

9. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of South Dakota, United States.
